2)  The Contest timeframes are as follows:
  Contest entry timeframe for Drawing 1, 2 & 3: 12:00 AM PST on 1/14/03 to 11:59 PM PST on 1/20/03.
  Contest entry timeframe for Drawing 4, 5 & 6: 12:00 AM PST on 1/21/03 to 11:59 PM PST on 1/27/03.
  Contest entry timeframe for Drawing 7, 8 & 9: 12:00 AM PST on 1/28/03 to 11:59 PM PST on 2/3/03.

Methods of entry:
 a)  Ebates members may sign up on the designated contest entry page. Only one entry allowed per this method per drawing (only one valid e-mail address per account).
 b)  Ebates member may also 'Refer a friend' on the designated contest referral page. Maximum of 50 referral entries permitted per contest week. Referral entries are recognized in the week of sign-up - not initial referral. Referrals must sign up with the email address to which the referral email was sent for the member entry to be tracked properly. Or you can hand print your name, address, day and evening phone numbers, and e-mail address on a 3"x 5" card a mail to: Ebates/Dell Home Systems New Year's Giveaway, 5 Thomas Mellon Circle, Suite 225, San Francisco, CA 94134. No mechanically created or printed entries are allowed. All entries become the property of Ebates and Dell.com. Odds of winning depend on number of eligible entries received. Contest open to legal residents of the 50 United States and District of Columbia, age 18 or older, except employees of Ebates or Dell.com, their affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and the immediate families of each.

4)  Except where prohibited, by accepting prize, winner consents to the use of his/her first name, email address and state information as provided at Contest Entry by Ebates and Dell.com for the purposes of Promotion and Direct Marketing. Winner will be notified by e-mail and will be required to respond within twenty (20) days of the sending of the notification, or the prize will be forfeited. The winners will be required to provide their Social Security number to Ebates and/or Dell.com for purposes of tax reporting in accordance with local, state and/or federal law. Failure to so provide all requested information will result in the forfeiture of any prize.

5)  At the end of the Contest, there will be 9 total winners.

6)  Only one winner allowed per household. Prizes not returnable and non-transferable. No substitutions allowed. Taxes on prizes are the responsibility of the winner. By accepting prizes, winners agree that Ebates and Dell.com, and their respective officers, directors, agents and employees will have no liability or responsibility for any injuries, losses or damages of any kind resulting from the acceptance, possession or use of any prize and they will be held harmless against any claims of liability arising directly or indirectly from the prizes awarded.

7)  Ebates and Dell.com are not responsible for lost, stolen, incomplete, damaged, late, failed, or misdirected transmissions, or for technical failures of any kind, including, but not limited to, electronic malfunction or damage to any network, hardware or software. Ebates and Dell.com are not responsible for any congestion, failure or malfunction of any telephone network or lines, on-line system, server or provider, computer equipment, or software. If the Internet portion of the program is not capable of running as planned for any reason, including tampering, computer virus, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Ebates or Dell.com which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Ebates and Dell.com reserve the right to cancel, modify or suspend the Contest. Any attempt by any person to deliberately damage any web site or undermine legitimate operation of the program is a violation of criminal and civil laws, and should such an attempt be made, Ebates and Dell.com reserve the right to disqualify and seek damages from any such individual to the fullest extent permitted by law. In the event of dispute over source of any electronic entry, the entry will be attributed to the owner of the e-mail account.

8)  Any dispute arising out of this contest will be decided in the sole discretion of Ebates and/or Dell.com. Should you not agree with the outcome as decided, your only recourse is to withdraw from the contest.
